DMCA Policy

Procedure under the Digital Millennium Copyright Act (17 U.S.C. § 512).
1. Designated DMCA Agent

2. How to file a DMCA takedown notice
If you believe that material posted on Solia Wall infringes your copyright, please send a written notification ("DMCA Notice") to the DMCA Agent above. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:
- Identification of the copyrighted work claimed to have been infringed. If multiple works are involved, you may provide a representative list.
- Identification of the material that is claimed to be infringing and that is to be removed, with information reasonably sufficient to permit us to locate it (typically a URL or specific description of where the material appears on Solia Wall).
- Your contact information, including: your full legal name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
- A physical or electronic signature of the copyright owner or of a person authorized to act on the owner's behalf.
We will not be able to act on incomplete notices. Please ensure all six elements are present.
3. Our response to a valid DMCA Notice
Upon receipt of a notice that complies with the requirements above:
- We will acknowledge receipt within 2 business days
- We will expeditiously remove or disable access to the allegedly infringing material
- We will notify the user who posted the material of the takedown and provide them with a copy of the DMCA Notice (subject to redaction of personal contact information if requested)
- We may suspend the account of a repeat infringer in accordance with Section 6 below
4. How to file a DMCA counter-notice
If your material has been removed from Solia Wall pursuant to a DMCA Notice and you believe in good faith that the removal was a mistake or misidentification, you may submit a counter-notice ("DMCA Counter-Notice") to the DMCA Agent. Under 17 U.S.C. § 512(g)(3), your counter-notice must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information, including: full legal name, mailing address, telephone number, email address.
- A statement that you consent to the jurisdiction of the United States Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, for any judicial district in which Solia Wall may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
5. Our response to a valid Counter-Notice
Upon receipt of a counter-notice that complies with the requirements above:
- We will promptly provide the original DMCA complainant with a copy of the counter-notice
- We will inform the original complainant that the material will be restored within 10 to 14 business days unless they file a court action seeking injunctive relief
- If the original complainant does not file such court action within 10 to 14 business days, we will restore the material
6. Repeat infringer policy
In accordance with 17 U.S.C. § 512(i), we have adopted and reasonably implemented a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We consider a user to be a "repeat infringer" if they have been the subject of two or more valid, unrebutted DMCA Notices within any 12-month period.
7. False notices
Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including attorneys' fees. Please consider these legal consequences carefully before submitting a notice or counter-notice.
8. Other intellectual property concerns
For trademark, patent, trade secret, or other intellectual property concerns not covered by the DMCA, please contact support@soliawall.com with details of your claim. We respond to all reasonable IP concerns within 5 business days.
